JUDGMENT AND REASONS Case No. 2401884/2022
EMPLOYMENT TRIBUNALS Claimant: Mr E Battin Respondent: Greater Manchester Mental Health NHS Foundation Trust Heard at: Manchester On: 2-12 December 2024 Before: Employment Judge Phil Allen (sitting alone)
REPRESENTATION: Claimant: In person Respondent: Mr J Boyd, counsel
JUDGMENT The judgment of the Tribunal is that:
1. The Tribunal does not have jurisdiction to consider three of the complaints of harassment related to disability as they were not brought within the time required by section 123 of the Equality Act 2010, and it was not just and equitable to extend time. Accordingly, those complaints, being those in the list of issues as issues 5.1.1, 5.1.2 and 5.1.7, are dismissed.
