JUDGMENT
1. The Claimant’s claim pursuant to s. 188 of the Employment Rights Act 1996 that the Respondent failed to make a payment under s. 182 of that Act was presented out of time. It wasreasonably practicable tohave presented the claim in time. Accordingly, the claim is dismissed.
2. On the Claimant’s reference under s. 170(1) of the Employment Rights Act 1996 it is determined that: a. The Respondent is liable to pay the employer’s payment; b. The amount of the sum payable is £6,461.56.
