JUDGMENT OF THE EMPLOYMENT TRIBUNAL 30 The Tribunal finds as follows:
1. The claimant was a worker in terms of Section 230 (3)(b) of the Employment rights Act 1996 on days worked by him when he received a voucher from the respondent for that day’s work between October 35 2018 and 31 August 2020.
2. The claimant was an employee of the respondent in terms of Section 230 (1) of the Employment Rights Act 1996 from 1 September 2020 until 5 March 2021.
