JUDGMENT OF THE EMPLOYMENT TRIBUNAL The unanimous Judgment of the Tribunal is : 35 (1) The respondents unlawfully withheld wages from the claimant in the sum of £3078.45 . The respondents shall pay to the claimant the said sum of £ 3078.45 in respect thereof.
ETZ4(WR) 4100531/2024 Page 2 (2) The claimant was due the sum of £1,523.25 on termination of her employment in respect of leave accrued but untaken as at that date. The respondents shall pay the said sum of £1,523.25 to the claimant. 5 (3) that the claimant’s claim of pregnancy discrimination does not succeed and is dismissed.
REASONS 10 1. The claimant submitted a claim to the Tribunal on 26 January 2024 having completed ACAS conciliation between 28 November 2023 and 9 January th
2024. In section 8 of her ET1 form the claimant ticked the boxes for unfair dismissal and discrimination on the grounds of pregnancy or maternity and race. She also ticked the box to state she was owed holiday pay and other 15 payments. The respondents submitted a response in which they denied the claims.
