JUDGMENT OF THE EMPLOYMENT TRIBUNAL 20 The Judgment of the Employment Tribunal is that the claimant is a disabled person in terms of Section 6 of the Equality Act 2010 (the EQA).
REASONS
1. This was a OPH to consider the issue of the whether the claimant was disabled in term of section 6 of the EQA. The claimant was represented by Mr 25 Merck and the respondents by Mr Briggs, both counsel.
2. The impairment relied upon is depression and anxiety. It is not in issue that the claimant has that impairment. What is in issue is whether that impairment has a substantial and long-term adverse effect on the claimant’s ability to carry out normal day-to-day activities. 30 3.
