JUDGMENT OF THE EMPLOYMENT TRIBUNAL The Tribunal refuses the application to strike out the Claim under Rule 38(1) of the Employment Tribunal Procedure Rules 2024.
REASONS Introduction
1. This was an open Preliminary Hearing held for the purposes of addressing an application for strike out, to which the respondent sought initially to add for a sist, and failing strike out a deposit order. The claimant is a party litigant and the respondent is represented by Mr Berham.
2. There had been an earlier Preliminary Hearing on 25 March 2025 before EJ Sutherland, after which case management orders were made. Claims were identified of unfair dismissal, breach of contract and race discrimination under sections 13, 26 and 27 of the Equality Act 2010.
