JUDGMENT OF THE EMPLOYMENT TRIBUNAL The unanimous Judgment of the Tribunal is that the claim is dismissed.
REASONS
1. The claimant, Mr Mahdi Daryoush, brought complaints of “ordinary” unfair dismissal and automatic unfair dismissal, by way of making a protected disclosure (whistleblowing). The respondent,Baker Hughes Limited,admitted that it had dismissed the claimant but claimed that the reason was “gross misconduct” and that it was fair.
2. The claimant maintained that he had made a protected disclosure to the respondent relating to a “tender proposal” which he had prepared and which he maintained he had been asked to redo but had refused, and that he had repeated his concern with regard to this request on four occasions.
