JUDGMENT OF THE EMPLOYMENT TRIBUNAL 25 The judgment of the Tribunal is that the claimant did not make a protected disclosure for the purposes of Part IVA of the Employment Rights Act 1996 (ERA). His claim of automatically unfair dismissal pursuant to section 103A of ERA is, therefore, dismissed.
REASONS 30 Introduction
1. The claimant was employed by the respondent from 9 May 2023 until he was dismissed on 17 August 2023. He complains that his dismissal was automatically unfair under section 103A of ERA because, he says, the reason or principal reason for his dismissal was that he made a protected disclosure. 35 The respondent denies the claim in its entirety.
2. A final hearing was listed to take place at the Glasgow Tribunal over 4 days.
