JUDGMENT

1. The Secretary of State for business, innovation, Science and Trade is dismissed as a respondent to the claim. The Secretary of State remains an interested party insofar as the claimants have claims to enforce any part of this Judgment under the state guarantees set out in part XII of the Employment Rights Act 1996.

2. The claims for a protective award succeed only in respect of the 29 named affected employees set out in the schedule to this judgment.
