JUDGMENT The judgment of the Tribunal is: 1. that the claimant was not disabled by reason of Asperger’s Syndrome at the material times, 2. the claimant’s claims for direct and indirect disability discrimination are hereby dismissed. For the avoidance of doubt the claimant’s claims for constructive unfair dismissal and victimisation are unaffected by this judgment.
REASONS Introduction
1. This case came before me at a public preliminary hearing to consider the sole question of whether the claimant met the definition of disabled in section 6 of the Equality Act 2010 at the material times.
