JUDGMENT OF THE EMPLOYMENT TRIBUNAL The judgment of the Employment Tribunal is:
1. The claim of direct discrimination is struck out under Rule 37(1)(a) & (c) of the 25 Tribunal Rules of Procedure.
2. The claim of breach of the duty to make reasonable adjustments in respect of, and only in respect of, the alleged failure to permit an occupation health referral and the alleged failure to allow the claimant to return to work on a phased basis after a period of absence are struck out under Rule 37(1)(a) of 30 the Tribunal Rules of Procedure.
3. The respondents’ application for strike-out is, otherwise, refused.
