1. The claim for unfair dismissal is well-founded. Contrary to section 104(4)(a) of the Employment Rights Act 1996 (“1996 Act”), Ms Bolotina was dismissed because she asserted the following statutory rights. 1.1 Her statutory right under section 1 of the 1996 Act to a written statement of employment particulars; and 1.2 Her statutory right under section 8 of the 1996 Act to a pay slip.
