REASONS
1. The claimant has presented whistleblowing claims against all five respondents, the individual respondents being employees or board members of the first respondent.
2. This preliminary hearing has been fixed to determine whether the claimant was a worker in relation to the first respondent by virtue of section 43K(1)(a) of the Employment Rights Act 1996, which was introduced to extend the definition of worker in order to provide protection for agency workers in relation to victimisation for protected disclosures made while working for an end user.
