20 JUDGMENT OF THE EMPLOYMENT TRIBUNAL The judgment of the Employment Tribunal is that: i) the claimant was disabled within the meaning of section 6 of the Equality Act 2010 at the relevant times; and ii) the claims for unfair dismissal, disability discrimination and breach of 25 contract are not well founded and are dismissed.

REASONS

1. The claimant lodged a claim in the Employment Tribunal for unfair dismissal, disability discrimination, breach of contract and arrears of pay on 3 May 2023 30 following his dismissal, effective 15 February 2023. The respondent resists the claims, asserting that the claimant was dismissed for a potentially fair reason namely capability; and that they acted reasonably in treating the claimant’...
